课 法律教育）
一、课文要点与难点
1 ．including professional training and sacialication of fu
ture lawyers and screening and gatekeeping for entrance to t
he profession（第27 页第1 段第6 行）：
socialization of future lawyers 是指对将要进入律师行业
的人员进行社交能力的培养，而screening and gatekeeping 是
指对准备进人法律职业的人进行筛选和把关。
2。 regulatory state（第28 页第1 段第3 行）：
regulate 的意思是指由行政机关制定和颁布具有约束力
的规章并依此行使管理职能regulatory 是其形容词形式。结合
前文一起理解，the modern regulatory state 的含义是指按照
法律规范进行管理的国家，可翻译为“现代规制国家”，是与
“法治国家”（ the state of rule of law）相近似的说法。
3。clinical education（第 28 页第1 段第4 行）：
诊所式教育，此处指的是法律诊所教育。这种教学形式
借鉴了医学院诊所教育的模式。在医学院就读的学生需要花
费较多的时间从事临床实习，从实践中学会诊断和治疗疾病。
当法学教育引人这种教学方法时，法学院引用了“诊所”的
称号，就产生了“法律诊所”这一法学领域特有的名称。学
生在一个真实或虚拟的“法律诊所”中，在教师的指导下为
处于困境中的委托人提供咨询，“诊断”他们的法律问题，开
出“处方”，为他们提供解决问题的方法，并亲自为他们提供
法律服务。这一做法类似于医学院的临床实习，即从实践和
经验中学习法律执业技能。用一句话来概括诊所式法律教育，
就是“通过法律实践学习律师的执业技能”。

三、相关知识
（一）美国的法律教育机构
在19 世纪以前的美国，法律教育的基本模式是“学徒”。
想当律师的人除了自己看一些法律书籍外，一般都要到一个
