一、课文要点与难点
1。the intricate network of relations between States and
Nation(第2 页第2 段第8 行):
此处States 虽然大写,但是指的不是United States 的简
写,结合上下文这里指的是美国的各州同联邦之间的关系。
而之所以用intricate(错综复杂的)这个词来形容这种关系,则
在于美国实行的是联邦制,除了有联邦宪法和法院体系外,
各州均有自己的宪法和法院体系。这两套并行的法律体系,
在法律适用过程中往往会产生许多问题,如适用州法还是联
邦法,联邦法的管辖权如何等等。同时,在美国的法律发展
过程中,也不断出现联邦权力侵蚀州权力的现象,因此,作
者在评价美国各州和联邦关系的时候,使用了intricate 一词。

行):
制定法和判例法皆是美国法律的法源。但是就法律效力
而言,制定法一般处于高于判例法的地位,从法理上讲应该
是制定降优先。但是,在此处所指的case law,不是一般的c
ase law,而是解释制定法的判例法(case taw interpreting ena
cted law)。就法源而言,解释制定法的判例法被视为其解释
的制定法的衍生物,在法源上的效力等级与其解释的制定法
相同。同时,鉴于制定法的目的在于制定一般性的规则,规
范的是未来的行为而不是解决具体的案件,因此,在司法实
践中,法院的大部分工作就是通过判例来具体解释制定法。
这样,虽然自20 世纪起,尤其是从被称为“法规年代”的3
0 年代起,大量的法规相继制定,州法的中心也从普通法转变
为制定法,但是在具体适用过程中,还是要通过判例来对制

3。forms of action(第2 页第3 段第2 行):
这里不仅是指诉讼的形式,而且是特指“严格的诉讼形
式”。严格的诉讼形式是英美法的历史产物。在英美法中,令
状(writ)是国王特许的书面命令,内容是国工同意某特定的个
人,因特定的事项得以向国王的法院提起诉讼,由于案件的
不同而须有不同的令状。例如,Trespass(直接侵权行为)。De
bt(返还确定数目的金钱),Repievin(非法强占的动产恢复)等。
当事人依据自己发生的事实选择法律规定的令状,而令状的
内容与当事人请求的事项必须相同,如果原告所请求的事实
与令状所述不同,就等于国王的命令有错误,此令状就无效,
原告在程序上就被驳回而败诉,原告必须重新中请新的正确
令状。
